Today the Chancellor dealt a blow to Entrepreneurs’ Relief (ER). This relief has been under the spotlight for some time from various bodies and individuals calling for its abolition, including the ex-Head of HMRC.

Having woken up with a great concern around the future of popular tax reliefs beginning with the letter E – Entrepreneurs’ Relief (ER), Enterprise Management Incentives (EMI) and the Enterprise Investment Scheme (EIS), the Budget delivered change to ER with the reduction in the lifetime limit from £10m to £1m (as well as some targeted anti-avoidance), but looks to have left EMI and EIS broadly untouched.

UK Budget 2020 – what it means for employers

I think anti-climax is how I would best describe today’s Budget from an employer’s point of view. Although we were not expecting any major headlines on IR35 following the recent conclusion of the Government’s “review”, the fact that it did not feature in the Chancellor’s speech at all, and the only mention of the imminent IR35 changes was a brief paragraph buried away on page 88 of the Budget publication confirming it is full steam ahead, was a surprise.

Despite the controversy and confusion and pre-election promises of a review it looks certain that IR35 will be implemented as planned on April 6. The recent consultation has closed, and the government are pressing ahead. However, there still remains a strong call for Rishi Sunak to halt the process, with demonstrations taking place outside Westminster and commentators lambasting the plans but this seems certain to be ignored.
