Autumn Statement 2015 – Entrepreneurs’ Relief remains unchanged

Despite concerns that significant changes would be made to Entrepreneurs’ Relief (ER) within the Autumn Statement 2015, the relief remains unchanged.

A number of changes were introduced in the Summer Budget 2015 aimed at restricting ER for contrived arrangements.  As a result of these changes genuine family business transactions were being caught by the changes with ER being denied. The government advised, in the Autumn Statement delivered on 25th November 2015, that they will bring forward legislation to amend the changes introduced by the Finance Act 2015 in order to support businesses which undertake genuine commercial transactions.  This is great news and we hope the changes are retrospective to ensure individuals who have recently made asset disposals will qualify for ER.
